Rochester, MN (KROC-AM News) - A Rochester man has worked out a plea agreement to settle charges stemming from a shooting that occurred in May of last year.

34-year-old Cleary Grubb has entered guilty pleas to a gross misdemeanor charge for transferring a weapon to an ineligible person and a misdemeanor count of carrying a pistol wall under the influence of alcohol. He was originally charged with reckless discharge of a firearm and child endangerment.

The criminal complaint in the case alleged Grubb was intoxicated and riding in the passenger seat of a vehicle driven by his wife when he fired off a single round from a .357 revolver. The discharge of the weapon shattered the passenger side window and the bullet became lodged in the vehicle's side pillar.

Grubb's wife told the police that he "was drunk and became paranoid" as they were leaving a barbecue and that they and their daughter were driving home when the shot was fired. She also indicated she saw her husband carrying the handgun when he began walking to their vehicle and she assumed he had put it away when he got inside. Moments after the gun discharged inside the vehicle, Grubb's wife said she put on the brakes and ordered her husband to get out before she drove herself and her daughter back to their home.

Court documents state that Grubb was outside the family's residence in northwest Rochester would police arrived and placed him under arrest. They found the gun in the vehicle and the bullet lodged in the side pillar.

Grubb was sentenced to two years probation, during which he cannot use or possess firearms, alcohol, or drugs other than medications.
