It's something you might have seen or done, but is it legal in Minnesota to ride in the back of a pickup truck bed?

Riding in the back of a pickup truck bed is a practice that's been around pretty much as long as pickups themselves have been around. And, of course, tailgating around the bed of a pickup is a common occurrence here in the Land of 10,000 Lakes and across the country, especially during football season in the fall.

But can you legally ride in the bed of a pickup truck while on a road or highway in Minnesota? The answer might surprise you. According to Magnum, a manufacturer of after-market truck products, there are 20 states where the practice is legal. Conversely, 31 other states have some type of law on the books that either regulates or bans riding in the bed of a pickup truck.

So which is it here in the North Star State? As it turns out, here in the Bold North, it's actually legal! Here's the skinny, according to Scott County, Minnesota:

Believe it or not, currently it is legal in Minnesota for humans to ride in the bed of a pickup truck, whether or not the truck has a topper. It is not safe, but it is legal. A driver may, however, be charged for reckless or careless driving if they are swerving or committing some other type of driving maneuver that may further endanger the passengers back there.

Now, keep in mind that while there isn't a specific state law in Minnesota that prohibits riding in the back of a pickup truck, that doesn't mean it's a good thing to do. Nelson Person Injury, LCC, a Minnesota law firm with offices in Minneapolis and St. Cloud, sum it up like this:

The allure of riding in the back of a pickup truck is undeniable for many—there’s a certain thrill, a sense of freedom that comes with it. However, just because something is legal doesn’t necessarily mean it’s safe. Minnesota has somewhat lenient laws regarding this activity, but the physical and legal risks are significant.
