Rochester Woman Admits to Illegal Use of Tear Gas
Rochester, MN (KROC-AM News) - A woman who was charged after a mace-spraying incident at the Olmsted County Fair last summer has been sentenced to a year on probation.
19-year-old Heavenly Unique-Leosha Davis today entered a guilty plea to a misdemeanor count of illegal use of teargas. Under the plea deal, a gross misdemeanor third-degree riot charge was dismissed.
According to the criminal complaint, the Olmsted County Sheriff's Office responded to a report of a fight and the spraying of mace near the entrance to the fairgrounds around 10 o'clock on the night of July 26. The initial reports indicated an altercation had apparently spilled over into a parking lot and an adult female involved in the disturbance deployed a canister of what was described as mace or bear spray, which caused the crowd to disperse.
The court document says a deputy was sent to meet with the woman who had called law enforcement dispatch to report the fight. The complaint says the woman was identified as Davis and told the deputy she had been assaulted at the fair and a woman attempted to spray a chemical irritant at her.
However, investigators viewed security camera videos that showed a woman, who was identified as Davis, chasing after a group of people while holding an object, and then raising it and spraying something at the other people. An Olmsted County Detention Deputy happened to be attending the fair with his family and reported seeing a woman matching the description of Davis holding a canister above her head and spraying a substance into the air.
Rochester firefighters and Mayo Clinic Ambulance crew members treated several people who were exposed to the aerosol spray at the scene. No serious injuries were reported.
